Terms of Use.
The terms that govern your use of the Hiras SMS Android application.
1. Acceptance of these terms
Hiras SMS ("the App") is developed and maintained by Charwin Amper, published under the Arcwhin software brand, based in the Republic of the Philippines ("the developer", "we", "us"). At the time of publication, Arcwhin is a software publishing brand operated by the developer and is not a separate legal entity. By downloading, installing, or using the App, you agree to these Terms of Use and to the Privacy Policy. If you do not agree, do not use the App.
You must be at least 18 years old (or the age of majority where you live) and legally able to enter into a binding contract to use the App. If you use the App on behalf of an organisation, you confirm you're authorised to accept these terms for it.
2. What Hiras SMS is
Hiras SMS is an Android application that turns your own phone into a local, self-hosted SMS gateway. It exposes a REST API on your local network so that apps you control can send SMS through your phone's SIM, and — optionally — forward inbound SMS to a webhook you configure. The App runs on your device; we operate no server and provide no messaging network. It is intended for lawful, user-controlled SMS integrations and is not designed or marketed as a bulk-messaging, mass-marketing, or campaign platform.
3. Your licence
Subject to these terms, you're granted a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own lawful use. The App is licensed, not sold. All intellectual property in the App remains with the developer. You must not copy, resell, sublicense, rent, decompile, reverse-engineer, or create derivative works from the App except to the extent the law expressly permits. Use through an app store is also subject to that store's terms; where required, the store is a third-party beneficiary of these terms.
What your purchase grants. Where the App is offered as a one-time purchase, buying it grants you a perpetual licence to use the version you obtained through the applicable app store, subject to these terms. What that price does and does not include — in particular regarding updates, future versions, and ongoing development — is set out in §13.
4. Acceptable use
Hiras is intended for lawful, user-controlled, consented messaging — including development and testing, one-time passwords (OTP) and account notifications for your own users, automation, and personal or project integrations. Because messages are sent through your own consumer SIM, you must comply with all applicable laws and with your mobile carrier's terms of service and fair-use policies, which govern the volume you can send.
5. Prohibited use
You must not use the App to:
- send spam, unsolicited bulk or marketing messages, or otherwise message people without a lawful basis or the consent required by law;
- send unlawful, fraudulent, deceptive, harassing, threatening, hateful, or obscene content, or facilitate scams, phishing, or "smishing";
- impersonate any person or organisation, or spoof sender identity;
- violate the Philippine SIM Registration Act (RA 11934), the Data Privacy Act (RA 10173), anti-spam or telecommunications rules, or equivalent laws where you or your recipients are located (for example, TCPA/CAN-SPAM-type rules abroad);
- breach your carrier's terms, exceed fair-use limits, or use the App for commercial bulk messaging that belongs on a licensed aggregator;
- attempt to bypass the App's local-network guard, rate limits, or authentication, or use the App to attack, overload, or gain unauthorised access to any system;
- rely on the App for emergency, life-safety, medical, or other critical communications.
You are solely responsible for the content and consequences of every message sent through your gateway.
6. Your responsibilities
- Your device & SIM. You provide and maintain the Android phone, SIM, mobile plan, and network the App runs on.
- Your API key. Keep it secret. Anyone with your key and network access can send messages at your expense. Regenerate it if it may be exposed, and run the gateway only on networks you trust (local API traffic is plain HTTP — see the Privacy Policy).
- Your webhook & VPN. If you configure a webhook or use a VPN to reach the gateway, you're responsible for those endpoints, their security, and their costs.
- Consent & records. You are responsible for obtaining and keeping any consent or authorisation needed to message your recipients.
7. Carrier charges & no delivery guarantee
Every SMS you send is billed by your mobile carrier at its normal rates and consumes your own load or plan allowance. Hiras does not provide SMS credits and charges no per-message fee. Message delivery depends on your SIM, signal, balance, the carrier, and the recipient's network — none of which are under our control. The App reports whether the carrier accepted a message for sending (and, where the device supports it, a sent/failed outcome), but we do not and cannot guarantee that any message is delivered, delivered on time, or delivered uncharged. Recipient delivery receipts are not provided.
8. Third-party services
The App interoperates with services you choose — your mobile carrier, any webhook endpoint you set, and any VPN software you install (e.g. Tailscale, WireGuard, ZeroTier). These are operated by third parties under their own terms, and we are not responsible for them, their availability, or their handling of your data. VPN/remote access is a best-effort convenience and is not guaranteed to work with any particular software, device, or network. Names of third-party products are used for identification only and do not imply any affiliation or endorsement.
9. No warranty
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that messages will be sent or delivered. You use the App at your own risk, to the maximum extent permitted by law. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, load or airtime, goodwill, or for messages that fail to send or deliver, undelivered or mis-delivered messages, unexpected carrier charges, or unauthorised use of your API key — arising out of or relating to your use of the App, even if advised of the possibility. To the extent any liability cannot be excluded, the developer's total aggregate liability is limited to the amount you actually paid for the App (if any) in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by applicable law (such as for death or personal injury caused by negligence, or fraud).
11. Indemnity
You agree to defend, indemnify, and hold harmless the developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, the messages you send or forward, or your breach of these terms or of any applicable law or third-party rights. This includes claims brought by message recipients or other third parties, and any fines, penalties, or actions by a regulator (such as the National Telecommunications Commission or the National Privacy Commission) or by your mobile carrier.
12. Termination
These terms apply while you use the App. You may stop using it and uninstall at any time. We may suspend or end your licence if you materially breach these terms or use the App unlawfully. Sections that by their nature should survive (licence limits, disclaimers, liability, indemnity, and governing law) survive termination. Any refund is handled under the policy of the app store you purchased through.
13. Product updates, changes & availability
Updates. Hiras SMS is sold as a one-time purchase, and the price reflects the App as it exists at the time of purchase. We may — at our sole discretion — provide bug fixes, compatibility updates, security improvements, or new features, but we are under no obligation to do so. Purchasing the App does not entitle you to future updates, feature enhancements, major new versions, ongoing development, continued support, or guaranteed compatibility with future Android versions. Any updates that are provided are offered voluntarily and may be discontinued at any time.
Changes & availability. We may modify, improve, suspend, discontinue, cease development of, or remove features of the App at any time, subject to applicable law, and we do not guarantee that any particular feature will remain available indefinitely. Where practical, material changes affecting existing users will be communicated through the App or the official website. None of this affects the perpetual licence to any version you have already obtained (see §3).
14. Changes, governing law & contact
We may update these terms as the App evolves; the "Last updated" date will change and, where appropriate, we'll note it in the App. Continued use after an update means you accept the revised terms. These terms are governed by the laws of the Republic of the Philippines, and you agree to the exclusive jurisdiction of the courts located there, without regard to conflict-of-laws rules and without affecting any mandatory consumer protections available to you locally.
General. If any provision of these terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions stay in full effect. These terms and the Privacy Policy are the entire agreement between you and the developer regarding the App and supersede any prior or contemporaneous statements, including marketing material on this website. Our failure to enforce any provision is not a waiver of it. You may not assign these terms; we may assign them to a successor of the App.
